Welcome to Macrocherry! These Terms & Conditions ("Terms") govern your use of the macrocherry.com website, our AI video courses, masterclasses, consulting services, and our private community platform hosted on Skool (collectively, the "Services"), operated by Ariane Gebhardt ("we", "us", "our").
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Services.

1. Services & Memberships

Macrocherry provides digital education, including pre-recorded courses, live masterclasses, and a membership-based community ("Macrocherry Academy").

• Community Access: Access to the Macrocherry Academy via Skool requires an active subscription.
• Free Trials: We may offer a 14-day free trial for new members. If you do not cancel before the 14-day period expires, your on-file payment method will be automatically charged the regular monthly subscription fee.

2. Payments & Billing

• All payments are processed securely through our third-party payment provider, Stripe.
• By providing a payment method, you expressly authorize us (via Stripe) to charge the applicable fees on a recurring monthly basis for subscription services.
• Prices are subject to change, but we will notify active members prior to any pricing changes affecting their subscription.
• You are responsible for ensuring your billing information remains current.

3. Cancellations & Refunds

• Subscriptions: You can cancel your monthly Academy subscription at any time via your account settings in Stripe or Skool. Cancellation will take effect at the end of your current billing cycle. You will retain access to the community until that cycle ends.
• Digital Products (EU Right of Withdrawal): Because our courses, masterclasses, and digital downloads provide immediate access to digital content, you expressly consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal from the contract once the download or stream has begun, in accordance with EU consumer protection laws.
• Consulting Services: Cancellations for 1-on-1 consulting or B2B sessions must be made at least 48 hours in advance to avoid a cancellation fee.

4. Intellectual Property & Usage Rights

All materials provided within the Services (including but not limited to video tutorials, exact AI workflows, prompt formulas, text, graphics, and logos) are the intellectual property of Macrocherry and Ariane Gebhardt.

• What you CAN do: You may use the workflows and prompts taught in our courses to create your own original content for personal or commercial use (e.g., creating ads for your clients).
• What you CANNOT do: You may not copy, record, distribute, share, or resell the course materials, login credentials, or the exact workflow PDFs to third parties. Sharing your account or reproducing our educational content for a competing business is strictly prohibited and will result in immediate termination of your account without a refund.

5. Community Rules (Skool)

We strive to maintain a supportive, high-value environment in our community. By joining, you agree to:

• Treat all members with respect.
• Not spam or aggressively pitch your own services to other members.
• Keep proprietary information and private feedback shared by other members confidential. We reserve the right to remove any member who violates these rules, without a refund.

6. Disclaimer of Guarantees

While we provide high-level educational content based on real industry experience, we do not guarantee specific financial results, career advancements, or view counts as a result of taking our courses. The AI landscape changes rapidly; while we strive to keep content up-to-date, certain tools or interfaces (e.g., Midjourney, Adobe Firefly, HeyGen) may update independently of our materials.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Macrocherry or its founder be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or relating to your use of the Services or any AI tools recommended therein.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
